Design, infringement and novelty searches
Design, novelty and infringement searches may be used e.g.:
- Prior to marketing of a product with a new design
- As the basis for an evaluation of the possibilities of unhindered introduction of a product in Denmark
- For mapping out the competitors’ design protected products
- As inspiration for design development
- As the basis for decisions which may reduce the risk of infringement cases.
Product characteristics
A design search is a search in Danish design registrations and publicly available design applications. The scope of the search will be agreed upon in each individual case. The search may clarify e.g.:
- whether the design is at a risk of infringing other design rights
- the extent of registered design rights and design rights applied for in certain categories of goods or by related specific businesses or individuals.
After having concluded the search, the Office will draw up a report with the following contents:
- Specification of the aim of the search
- The result of the search accompanied, where appropriate, by lists or copies of relevant design registrations and applications
- Comments as to whether the material found is "of particular relevance" or "for information" (in connection with searches for novelty or infringement)
- Description of the scope of the search.
Delivery
Delivery will normally take place within 5 working days. Urgent delivery may be agreed upon against an additional charge.
Prices
Design, novelty and infringement searches: 4000 DKK each (fixed price).
The above price is exclusive of VAT.
