Special time limits apply to the Faroe Islands and Greenland when a PCT application enters the national phase in Denmark.

When a PCT application enters the national phase special time limits apply to the Faroe Islands and Greenland (see below regarding updates for Greenland from 1 July 2010).

For these areas the time limit is 20 months from the date of filing the international application or, if priority is claimed, from the priority date. If the applicant has filed a request for an international preliminary examination report the time limit may be 30 months for Greenland however, in the case of the Faroe Islands, it is 20 months.

For the rest of the Danish territory the time limit is 31 months from the date of filing the international application or, if priority is claimed, from the priority date.

If a PCT application is to include the Faroe Islands and Greenland in the national phase, it must be in the form of a Danish translation of the international application.

If a PCT application enters the national phase in Denmark after the expiry of the special time limits the application will not cover the Faroe Islands and Greenland.

The Danish Patent and Trademark Office is currently working on updating the legislation for the Faroe Islands and Greenland. Please notice that the updated legislation for Greenland comes into force 1 July 2010. From this date the time limit for Greenland will be 31 months.
Furthermore from 1 July 2010 a PCT application which enters the national phase in Denmark by filing an English application will cover Greenland (but not the Faroe Islands).
