Designs

With a Danish design registration you have a good starting point for protecting the shape and appearance of your product. It only takes us approximately 3-4 weeks to process your application and this means that you quickly get proof of ownership to your idea. A design protection is valid for up to 25 years, as long as you pay the renewal fee every 5 years.

How to apply for a design registration?

You can submit your application by e-mail or ordinary post. See our information on secure e-mail.

From the moment your design has been made publicly available, you have a grace period of 12 months before you have to submit your application for a design registration. You can read about grace period in section 6 of the Design Act.

The basic fee for a design application is DKK 1,200. VAT will not be added to this fee.

Filling in your design application


There are no formal requirements regarding the format of the application. However, your design application should, at least, contain the following 3 items:

 

 

1. Information about the applicant and, if applicable, representative

 We do not require foreign applicants to appoint representatives.

2. A representation of your design

Images of your design is a requirement for the application to be assigned an application date. If the images are not sufficiently clear or in other ways do not meet the requirements, we will contact you to help you. It is important to note that if the images of the design are not sufficiently clear, the application is not assigned an application date.

 

3. A product indication

You must classify your product in accordance with the Locarno Classification. A deficient classification in the application does not result in it being rejected. We may propose a different class than the one specified in the application. In either case, we will contact you. 

Our examination

It takes about three weeks for us to process your application. If there are deficiencies in the application, we will contact you to help correct them. 

In addition to formalities, we examine

  • whether the application actually concerns a design, as opposed for example to a patent
  • whether the design is contrary to public policy or to accepted principles of morality, and
  • whether the application contains more than 1 design. Design applications may contain several designs if they fall under the same main Locarno class.

Want to postpone publication of your design?

You can request a deferment of publication. Requests can be made in the application, but are also accepted until the time of registration. Publication can de deferred for up to 6 months after the application or priority date. If you have deferred the publication but wish to publish in this period, you can send us a request.
