Design Board sees the light of day

The Design Board is built onan ambition to offer a fast and affordable alternative to court proceed-ings in cases of rights to architecture, design and crafts.

The Design Board was launched on Thursday 24 February and is a so-called private dispute board.

The Design Board is built onan ambition to offer a fast and affordable alternative to court proceedings in cases of rights to architecture, design and crafts.

The Design Board may issue advisory opinions in cases where two or more parties disagree on whether a design is protected by copyright, design law or marketing law, and whether the design has been infringed. The associated Response Committee will also be able to issue advisory opinions, where one party seeks an opinion on whether a design is protected by legislation in the above areas. The cost of an advisory opinion from the Design Board is DKK 25,000 and DKK 12,500 from the Response Committee.

The Trade Organisations intention with the creation of the new Design Board is to provide access to fast and qualified assessments at relatively low cost in the hope that several lawsuits can be avoided.

The parties in a dispute before the Design Board have the opportunity to agree that the Board's opinion is binding. The parties may also agree that the Board can decide on the amount in case of compensation.
