Therefore, the DKPTO has proposed a bill to amend the Patent Act and various other laws. Under the proposal, fees for patents, trademarks, designs, utility models, and semiconductors (topographies) will be increased by 20 per cent.
The DKPTO’s fees have not been adjusted since 2002, with the exception of a few selected fees which were price- and wage-regulated in 2023–2025. The proposed 20 per cent increase should therefore be viewed in the context that fees would today be approximately 45 per cent higher, had they been adjusted annually for prices and wages since 2002.
The proposal also includes a reduction of the transmittal fee for international patent applications (PCT applications), bringing it more in line with the fee levels of the European Patent Office (EPO) and the World Intellectual Property Organization (WIPO). Lowering the fee will create a more competitive level and attract more PCT applications.
The bill has been subject to public consultations, and we expect it to be finally adopted by mid-December 2025 with effect from 1 January 2026.
